This End User License Agreement ("Agreement") is a binding legal agreement between you ("User" or "you") and TapIn ("Company," "we," "us," or "our") concerning your use of the TapIn mobile application and related services (collectively, the "Service").
By downloading, installing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to this Agreement, do not download, install, or use the Service.

The Service uses location-based features. By using these features, you consent to the collection and use of your location data. You can control location permissions through your device settings.
The Service and its original content, features, and functionality are owned by TapIn and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Any feedback, suggestions, or ideas you provide about the Service become our property and may be used without compensation or attribution to you.
The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.
We may update the Service from time to time. Updates may include:
We may also modify this Agreement. Continued use of the Service after modifications constitutes acceptance of the updated Agreement.
You may terminate this Agreement at any time by deleting the Service and your account.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM:

You agree to indemnify, defend, and hold harmless TapIn and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
This Agreement shall be governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from this Agreement shall be resolved in the courts of the United States.
Before filing a lawsuit, you agree to try to resolve any dispute informally by contacting us. If a dispute is not resolved within 30 days, any resulting legal actions must be resolved through final and binding arbitration, except that you may assert claims in small claims court.
If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full effect.
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and TapIn regarding the Service and supersedes all prior agreements and understandings.
Our failure to enforce any right or provision of this Agreement shall not be considered a waiver of those rights.
